Alckmin erra ao querer acelerar processo de patentes
Recentemente, Geraldo Alckmin, ministro do Desenvolvimento, Indústria e Comércio e Serviços (MDIC), propôs diminuir o tempo de registro de patentes no Instituto Nacional da Propriedade Industrial (Inpi) de três para dois anos, o que gerou críticas por parte do Grupo de Trabalho sobre Propriedade Intelectual (GTPI). Segundo o GTPI, essa medida poderia resultar em uma diminuição da qualidade do exame técnico realizado pelo INPI, colocando em risco a soberania nacional e violando direitos fundamentais como o direito à vida e à saúde da população brasileira.
Essa proposta do ministro Alckmin é equivocada, pois não se trata apenas de uma burocracia, como ele sugere. Na realidade, o tempo de registro de patentes é importante para garantir que o INPI possa fazer uma análise cuidadosa e detalhada de cada processo. Uma análise superficial e rápida pode resultar em patentes concedidas de forma equivocada, o que pode prejudicar a saúde e a segurança da população.
Vale lembrar que a aceleração do processo de análise de patentes durante o governo Bolsonaro resultou em uma perda de qualidade na análise e na violação de direitos fundamentais. O GTPI argumenta que não há necessidade de acelerar o processo, pois os grandes conglomerados transnacionais não vão reduzir seus investimentos em inovação porque um produto não foi ou demorou para ser patenteado no Brasil. Eles também não vão investir mais recursos no Brasil porque uma patente foi concedida ou demorou menos tempo para ser concedida pelo INPI. Certamente, eles não vão se retirar do valiosíssimo mercado brasileiro por conta da demora ou pela impossibilidade de se conceder uma patente em nosso território.
Portanto, é importante que o processo de registro de patentes seja mantido com o tempo necessário para que o INPI possa realizar uma análise cuidadosa e detalhada de cada processo. Isso é fundamental para garantir a segurança e a saúde da população, além de preservar a soberania nacional.
